These Terms and Conditions (“Terms”) govern all bookings and travel services supplied by Hiking Friends Travel Nepal Pvt. Ltd., a Nepal-registered trekking and travel company with its principal office at Soaltee Dobato, Bafal, Kathmandu, Nepal (“Hiking Friends”, “we”, “us”, or “our”). Our Tourism Office Licence No. is 3331/081/082, our Company Registration No. is 330032/080/081, and our Nepal Mountaineering Association Resource Membership No. is 1807.
Please read these Terms carefully before booking. They contain important information about payments, cancellations, itinerary changes, travel risks, insurance, responsibilities, and limits of liability. By submitting a booking request, paying the 5% deposit or any other part of the Trip Price, or beginning a Trip, you agree to these Terms.
Nothing in these Terms excludes or restricts a right or remedy that cannot lawfully be excluded or restricted.
In these Terms:
2.1 A booking request is not confirmed until we issue a Booking Confirmation and receive the required deposit or full payment. Before confirmation, availability and quoted prices may change.
2.2 The contract consists of, in descending order of priority:
If two documents conflict, the document higher in this list controls to the extent of the conflict.
2.3 Website content, social-media content, photographs, maps, elevation data, reviews, sample itineraries, and verbal statements are general information only. They become contractual only if expressly included in the Booking Confirmation.
2.4 We may correct an obvious pricing, typographical, or calculation error before confirmation. If we discover a material error after confirmation, we will promptly offer you the corrected booking or a full refund of amounts paid to us for the affected services.
2.5 These Terms apply to bookings made directly with us. If you book through a travel agent, marketplace, or other intermediary, that party’s terms may also apply. The intermediary is responsible for passing communications and payments between you and us unless we agree otherwise in writing.
3.1 The Lead Booker confirms that they:
3.2 Each Traveler is individually bound by these Terms. The Lead Booker is our primary contact, and communications sent to the Lead Booker are treated as sent to all Travelers in that booking.
3.3 Travelers under 18 must travel with a parent, legal guardian, or responsible adult authorized in writing by the parent or guardian. We may require consent forms, identity documents, and other safeguards.
4.1 You must give us complete, current, and accurate information, including your legal name as shown in your passport, date of birth, nationality, contact information, emergency contact, medical information relevant to the Trip, dietary needs, and any mobility or accessibility requirements.
4.2 You must immediately tell us if relevant information changes. You are responsible for costs or losses caused by incorrect, incomplete, or late information, including ticket reissue, permit replacement, supplier fees, or denied boarding or entry.
4.3 Tell us before booking if you have a disability, reduced mobility, medical condition, allergy, dietary restriction, religious requirement, or other need that may affect your participation. We will make reasonable efforts to accommodate a request but cannot guarantee it unless confirmed in writing. Remote terrain, basic facilities, and limited transport or medical access may make some requests impossible to fulfil safely.
4.4 A special request is not a condition of the contract unless we expressly confirm it in writing.
5.1 The Trip Price and payment currency are stated in the Booking Confirmation. Unless stated otherwise, prices are per person and include only the items expressly listed as included.
5.2 You are responsible for international transfer fees, card fees disclosed before payment, correspondent-bank charges, currency-conversion costs, and other payment-provider fees. Payment is complete only when we receive cleared funds for the full amount due.
5.3 After confirmation, we may increase the Trip Price only where a direct increase results from a change in:
We will provide the reason and calculation. We will absorb an increase of up to 2% of the Trip Price. We will not impose a surcharge within 20 days before departure. If a surcharge exceeds 8% of the Trip Price, you may accept the change or cancel within the stated response period and receive a full refund of amounts paid to us for the affected Trip.
5.4 If the factors in Section 5.3 create a material cost reduction before full payment, you may request a corresponding price reduction, less reasonable administrative costs actually incurred.
6.1 Standard deposit. Unless the Booking Confirmation clearly states otherwise, a deposit equal to 5% of the Trip Price is required to confirm a booking.
6.2 The standard deposit may be paid by PayPal or bank transfer using the payment instructions supplied by us. Never send money to an account or link that has not been verified through our official contact details.
6.3 After receiving the deposit and required Traveler information, we will issue a Booking Confirmation and provide the available pre-trip information.
6.4 Balance payment. Unless the Booking Confirmation states otherwise, the remaining balance may be paid upon arrival in Nepal, before the Trip begins, in cash or by another payment method agreed with us.
6.5 A Tibet or Bhutan journey, peak-climbing permit, restricted-area permit, issued air ticket, charter, helicopter service, premium hotel, or other supplier-controlled service may require earlier payment or additional documents. Any different payment deadline must be clearly stated in the Booking Confirmation or Special Conditions before you confirm the booking.
6.6 The deposit forms part of the Trip Price and is not an additional charge.
6.7 Payment is complete only when cleared funds are received. You are responsible for bank, card, PayPal, correspondent-bank, or currency-conversion charges disclosed before payment. We will issue a receipt or written payment acknowledgement.
6.8 If you fail to pay an agreed amount when due, we may give reasonable notice requiring payment. If payment is still not made, we may treat the booking as cancelled by you under Section 8. We are not required to start the Trip or release permits, tickets, or vouchers before receiving amounts and information then due.
7.1 We will send final joining instructions, vouchers, or other documents after receiving all required information and payment. You must promptly check every document and tell us of any error.
7.2 Electronic documents are valid. You are responsible for carrying accessible copies and any originals required by authorities or suppliers.
8.1 To cancel, the Lead Booker or affected Traveler must notify us in writing at info@hikingnepaltrek.com or through our official WhatsApp number. Cancellation takes effect when we receive the notice. Time is calculated in Nepal Standard Time.
8.2 The Trip start date and time are those in the Booking Confirmation. If no start time is stated, the Trip is treated as starting at 9:00 a.m. Nepal Standard Time on the first itinerary day.
8.3 Our standard cancellation policy is:

8.4 For clarity, the Booking Amount in the 2% cancellation charge means the total Trip Price attributable to the cancelling Traveler or Travelers, not only the 5% deposit. For example, if the Trip Price is USD 1,000 and only the standard USD 50 deposit has been paid, cancellation within 48 hours results in a USD 20 charge and a USD 30 refund.
8.5 Where cancellation is received before the Trip starts, we will not make an additional deduction for our own administration. Any Special Condition that changes the standard refund policy must have been clearly disclosed and accepted before booking.
8.6 Approved refunds will be returned through the original payment method whenever possible. We normally initiate a refund within 14 business days after confirming the amount and receiving any reasonably required payment details. A bank or payment provider may take additional time to credit the funds.
8.7 A Traveler who voluntarily leaves after the Trip has started is not entitled to a refund for services already provided, used, or reasonably committed. We will refund any identifiable amount for a cancelled service that was neither used nor committed, where required by the Booking Confirmation or applicable law.
8.8 If one person cancels from a shared or group booking, the price payable by remaining Travelers may change because of room, vehicle, guide, permit, or group-size pricing. We will explain any change before it becomes payable.
8.9 If you purchased travel services through an agent or marketplace, the refund may need to be processed through that party. Their separately disclosed service or payment fees may be governed by their own terms.
9.1 You may ask to transfer your place to another eligible person. Approval depends on supplier, airline, visa, and permit rules, sufficient notice, and the replacement Traveler meeting all Trip requirements. We will disclose any unavoidable ticket, permit, supplier, or administrative cost before confirming the transfer.
9.2 Air tickets, visas, and permits may be non-transferable even where the Trip booking itself can be transferred.
9.3 If you wish to postpone instead of cancel, contact us as early as possible. We will make reasonable efforts to accommodate the new date. A Traveler-requested postponement is subject to availability, permit and supplier approval, seasonal price differences, and any unavoidable third-party change cost disclosed before acceptance.
9.4 A postponement is confirmed only when we agree to it in writing and issue a revised Booking Confirmation. If we cannot agree to the requested date, you may keep the original booking or cancel under Section 8.
9.5 If we cancel the Trip and you choose postponement under Section 11, there is no postponement charge from us. The replacement date remains subject to availability, and the treatment of any requested upgrade or materially different itinerary will be agreed in writing.
10.1 We will try to accommodate a requested change but cannot guarantee it. You must pay any resulting supplier cost, cancellation charge, price difference, permit or ticket fee, and reasonable administrative cost disclosed before the change is made.
10.2 A requested reduction in services after confirmation does not automatically reduce the Trip Price.
11.1 Adventure travel requires flexibility. We may make a minor change to transport, route, accommodation, guides, meals, sequence, or timing where reasonably necessary. A minor change does not entitle you to compensation or cancellation.
11.2 If we make a significant change before departure, we will inform you as soon as reasonably possible and offer you a choice of:
A significant change may include a substantial change to the main destination, a change of more than 24 hours to the scheduled start or finish, a material reduction in the standard of principal accommodation, or a price increase of more than 8%.
11.3 You must tell us your choice within the reasonable response period stated in our notice. If you do not respond, we may treat you as accepting the change only after sending a reminder and giving a final reasonable response period.
11.4 We may cancel a Trip before it starts if:
11.5 If we cancel because minimum numbers are not reached, we will normally give at least 21 days’ notice for a multi-day Trip and offer either a suitable alternative or a full refund of all payments made to us for that Trip.
11.6 If we cancel before the start because of a natural disaster, government restriction, safety concern, transportation disruption, other Force Majeure Event, or another reason not caused by your breach, you may choose:
11.7 If we cancel because of your material breach after reasonable notice where notice is practicable, the cancellation is treated under Section 8.
11.8 Where a disruption occurs after the Trip has started, Sections 12 and 13 apply.
11.9 Unless mandatory law requires otherwise, we are not responsible for separate arrangements not booked with us, such as independent international flights, visas, vaccinations, insurance, equipment, or additional accommodation. You should purchase flexible arrangements and adequate insurance.
12.1 A Force Majeure Event is an unavoidable and extraordinary event beyond the reasonable control of the affected party, the consequences of which could not reasonably have been avoided even if all reasonable measures had been taken. Examples include severe or unusual weather, avalanche, landslide, earthquake, flood, wildfire, epidemic or pandemic, public-health measure, war, threat of war, terrorism, civil unrest, border closure, government action, permit suspension, airspace or airport closure, major transport disruption, strike not limited to our own workforce, cyberattack on essential infrastructure, or failure of public utilities.
12.2 Neither party is in breach for delay or failure caused by a Force Majeure Event. We will take reasonable steps to protect Travelers, reduce disruption, and offer a practicable alternative where available.
12.3 If a Force Majeure Event causes us to cancel the Trip before it starts, the full-refund or no-charge postponement options in Section 11.6 apply.
12.4 If a Force Majeure Event occurs after the Trip starts, we may change, suspend, relocate, shorten, or end affected services where reasonably necessary. We will prioritize safety, provide reasonable assistance, and offer a suitable alternative where practicable. We will address any refund for services we cancel and cannot replace in accordance with the Booking Confirmation and applicable law.
12.5 Additional costs caused by a Force Majeure Event after the Trip starts—including extra accommodation, meals, transport, rescue, evacuation, testing, quarantine, or replacement flights—are the Traveler’s responsibility unless we caused the cost by our breach, expressly agree to include it, a supplier is responsible for it, or it is covered by insurance.
12.6 We will reasonably assist you with an insurance claim and provide available supporting documents on request.
13.1 Routes, schedules, walking times, elevations, photographs, and descriptions are reasonable estimates, not guarantees. Mountain weather, trail damage, altitude, road conditions, flight disruption, local events, wildlife, group ability, and authority decisions may require changes without prior notice.
13.2 The Trip leader or guide may change the route, pace, accommodation, activity, transport, acclimatization plan, or schedule where reasonably necessary for safety, welfare, legal compliance, or responsible trip operation. Their safety decisions are final while the Trip is in progress.
13.3 Reaching a summit, pass, base camp, viewpoint, cultural site, or other objective is never guaranteed. Failure to reach an objective because of weather, trail conditions, altitude symptoms, personal ability, safety considerations, authority restrictions, or a Force Majeure Event does not by itself entitle you to a refund.
13.4 If we change the itinerary after departure for a reason within our control, we will provide an appropriate alternative where reasonably possible. If the change is caused by you, a third party unconnected with our services, or circumstances beyond our control, additional costs are your responsibility.
14.1 You are responsible for obtaining and carrying a valid passport, visa, transit authorization, vaccination or health certificate, travel insurance evidence, parental consent, and any other document required by a destination, transit country, airline, or authority.
14.2 You must check official requirements applicable to your nationality, residence, transit route, health status, and travel dates. Requirements can change at short notice. General information from us is assistance only and is not legal, immigration, or medical advice.
14.3 Where we arrange a permit or visa service, issuance remains subject to the relevant authority. We are not responsible for refusal, delay, cancellation, border denial, or changed rules unless directly caused by our failure to use reasonable skill and care.
14.4 No refund is due where you cannot travel because your documents are missing, invalid, damaged, inconsistent, or rejected, subject to the cancellation scale in Section 8.
15.1 Many Trips involve strenuous activity, high altitude, steep or exposed terrain, basic sanitation, long travel days, extreme temperatures, and delayed access to medical care. You must review the Trip difficulty and obtain appropriate medical advice before booking.
15.2 By joining a Trip, you confirm that you are physically and mentally capable of participating, except for conditions disclosed to us and accepted in writing. You must prepare and train appropriately.
15.3 Before confirmation—and again if anything changes—you must disclose any condition that could affect your safety or the safety or experience of others. This includes heart or lung conditions, high blood pressure, diabetes, severe allergies, epilepsy, recent surgery or injury, pregnancy, mobility limitation, mental-health condition, medication dependency, or previous serious altitude illness.
15.4 Disclosure does not automatically exclude you. We may request a medical certificate or further information. Acting reasonably and after considering available adjustments, we may decline or restrict participation where the Trip presents a material safety risk that cannot reasonably be managed.
15.5 You are responsible for prescribed medication, spare supplies, and knowing how to use them. Guides cannot guarantee refrigeration, sterile storage, or administration of medication.
15.6 High-altitude illness can affect any person regardless of age or fitness. You must follow acclimatization and safety instructions and immediately report symptoms. A guide may require rest, descent, evacuation, or withdrawal from the Trip.
16.1 Unless we expressly waive the requirement in writing for a low-risk local activity, every Traveler must have comprehensive travel insurance from booking until return home.
16.2 The policy must be valid for all destinations, activities, and the Trip’s maximum altitude and must provide adequate cover for:
16.3 You must provide insurer, policy, emergency-assistance, and coverage details on request. We may refuse participation where adequate insurance cannot be shown. This will be treated as a cancellation by you.
16.4 You are responsible for understanding exclusions, excesses, altitude limits, pre-existing-condition rules, and claims procedures. Our review of a policy or certificate is not confirmation that coverage is sufficient.
17.1 You acknowledge that adventure travel involves inherent and sometimes serious risks, including altitude illness, slips and falls, rockfall, avalanche, landslide, flood, earthquake, severe weather, cold or heat injury, road and aviation incidents, illness, food- or water-borne disease, wildlife, isolation, limited communications, political or cultural events, and delayed rescue or medical treatment.
17.2 You voluntarily accept the ordinary and inherent risks of the Trip that remain after reasonable safety measures are taken. You agree to follow briefings, use required safety equipment, exercise reasonable care, and act within your ability.
17.3 This acknowledgment does not release us from liability for negligence, fraud, wilful misconduct, or any duty that cannot legally be excluded.
18.1 If we reasonably believe urgent action is needed to protect you or another person, you authorize us to arrange medical care, search and rescue, helicopter or ground evacuation, transport, accommodation, repatriation, or other emergency assistance. We will try to contact you, your emergency contact, and your insurer where practicable, but safety may require immediate action.
18.2 You are responsible for all emergency and evacuation costs relating to you, except to the extent caused by our breach or covered and paid by an insurer or another responsible party. You agree to reimburse costs we reasonably advance on your behalf.
18.3 Evacuation availability and response time cannot be guaranteed. Weather, terrain, daylight, aircraft, communications, authorities, and medical judgment may cause delay.
19.1 Airlines and transport providers control schedules, routes, baggage limits, and operations. Mountain flights—including flights to or from Lukla and other remote airstrips—are particularly weather-dependent and may be delayed, diverted, or cancelled.
19.2 A carrier’s conditions of carriage apply in addition to these Terms. Your name must exactly match your passport. Once issued, a ticket may be non-refundable and non-transferable.
19.3 Where a flight or transport disruption affects the itinerary, we will provide reasonable assistance and try to rearrange included services. Additional flights, helicopters, accommodation, meals, or transfers are payable by you unless included in the Trip, caused by our breach, paid by the carrier, or covered by insurance.
19.4 You should allow sufficient contingency time before an international departure and avoid inflexible onward arrangements immediately after a mountain Trip.
20.1 Accommodation in trekking regions may be simple, shared, unheated, and subject to limited electricity, hot water, internet, sanitation, or private bathroom facilities. Standards are local and may differ from international classifications.
20.2 Room types and bedding requests are subject to availability. If you book on a shared-room basis and no suitable roommate is available, a disclosed single supplement may apply. A single room or tent is not always available in remote areas.
20.3 Menus may be limited by location and supply. We will make reasonable efforts for dietary needs disclosed before booking but cannot guarantee an allergen-free environment or prevent cross-contamination.
20.4 Optional activities and services purchased directly from a third party and not listed in our Booking Confirmation form a separate contract between you and that provider. We are not responsible for their performance merely because a guide helped translate or identify the provider. An optional activity expressly sold by us in writing forms part of our contract to the extent stated.
21.1 You must:
21.2 We may refuse or end your participation, without refund, if your conduct, condition, equipment, documentation, or failure to follow instructions creates a material risk, breaks the law, or seriously affects others. Where practicable, we will give a warning and opportunity to correct the issue, but immediate action may be taken for safety or serious misconduct.
21.3 You are responsible for return travel, accommodation, medical care, fines, damage, and other costs resulting from your removal, except to the extent caused by our breach.
22.1 You are responsible for your baggage, valuables, travel documents, and personal equipment. Do not place cash, passports, medication, electronics, or irreplaceable items in checked or porter-carried baggage.
22.2 You must bring clothing and equipment suitable for the supplied packing list and Trip conditions. We or the Trip leader may reject unsafe or unsuitable equipment.
22.3 Airline, vehicle, animal, and porter baggage limits are strict. You must pay excess-baggage or additional-porter charges. Unless stated otherwise, the applicable limit will be shown in the final trip information.
22.4 Normal wear, weather exposure, and handling risks apply to porter-carried and transported baggage. We are responsible for loss or damage only to the extent provided in Section 25 and applicable law.
23.1 Travelers must follow “leave no trace” practices, use designated sanitation and waste systems, avoid wildlife disturbance, and comply with local conservation rules.
23.2 Do not photograph or record people, ceremonies, homes, or restricted places without permission. Dress and behave respectfully at religious and cultural sites.
23.3 We support lawful and responsible working practices for guides, porters, drivers, and crew. Travelers must not pressure staff to carry unsafe loads, ignore safety procedures, or act contrary to law or responsible-travel standards.
24.1 We arrange many services through independent suppliers, including airlines, hotels, lodges, transport operators, guides, permit authorities, and activity providers. Their lawful conditions of carriage or service may apply and are available on request where reasonably obtainable.
24.2 Suppliers are responsible for operating their services. We remain responsible for selecting and arranging contracted services with reasonable skill and care and to the extent required by applicable law.
24.3 International conventions or laws governing a carrier, hotel, or other supplier may limit or exclude compensation for delay, injury, baggage, or other claims. We may rely on the same limitations to the extent permitted by law.
25.1 We will use reasonable skill and care in arranging and providing the services in the Booking Confirmation. If we or a supplier providing a contracted service fails to do so, we will provide an appropriate remedy where required by law.
25.2 We are not liable to the extent a loss is caused by:
25.3 You must take reasonable steps to reduce loss and must not recover twice for the same loss from us, a supplier, insurer, card provider, or other person.
25.4 To the maximum extent permitted by law, our total liability for claims not involving death, personal injury, fraud, gross negligence, or wilful misconduct is limited to three times the affected Traveler’s Trip Price. This limit does not apply where a higher or non-excludable liability is imposed by mandatory law.
25.5 We are not liable for a loss that was not reasonably foreseeable when the contract was formed, or for business loss arising from a booking made as a consumer. Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, wilful misconduct, or any liability that cannot legally be excluded or limited.
25.6 Any compensation is subject to applicable international conventions and supplier limitations, including those governing air, sea, rail, and road transport.
26.1 If a problem occurs during the Trip, tell the guide, Trip leader, or supplier immediately so there is a reasonable opportunity to fix it. If it is not resolved, contact our Kathmandu office as soon as practicable.
26.2 After the Trip, send a written complaint to info@hikingnepaltrek.com, preferably within 30 days, with your booking reference, a clear description, supporting evidence, and the remedy requested. A delay will not remove rights that cannot lawfully be waived, but it may make investigation or correction more difficult.
26.3 We will acknowledge a formal complaint promptly and aim to provide a substantive response within 30 days, or explain why more time is reasonably needed.
27.1 We process personal data to respond to enquiries, administer bookings and payments, obtain permits and tickets, provide travel services, protect health and safety, comply with law, and handle complaints. Our separate Privacy Policy provides further details.
27.2 We may share necessary information with guides, hotels, airlines, transport providers, permit and border authorities, payment processors, insurers, emergency providers, professional advisers, and other suppliers, including recipients outside your home country.
27.3 Passport details, health information, and emergency contacts will be used only where reasonably necessary for trip administration, safety, legal compliance, or emergencies and will be protected using reasonable safeguards.
27.4 We will not use an identifiable photograph or video of you for advertising without permission. You may withdraw future marketing permission at any time, but this will not require withdrawal of material already lawfully printed or published where removal is not reasonably practicable.
28.1 Website access is provided on an “as available” basis. We try to keep information accurate and secure but do not guarantee uninterrupted access or that every item is free from error. Nothing in this Section limits responsibility for confirmed travel services.
28.2 Unless otherwise stated, our website text, itinerary content, logos, graphics, photographs, videos, and design are owned by or licensed to us. You may view and download reasonable extracts for personal trip planning, but may not reproduce, sell, scrape, republish, or commercially exploit them without written permission.
28.3 You must not misuse the website, attempt unauthorized access, introduce malicious code, submit false information, or use the site unlawfully.
28.4 Links to third-party websites are provided for convenience. We do not control or endorse third-party content merely by linking to it.
29.1 You agree that booking documents, notices, and signatures may be provided electronically. You must monitor the email address and telephone number supplied to us, including spam folders, and keep those details current.
29.2 A notice to us should be sent to info@hikingnepaltrek.com or through our official WhatsApp number. Urgent in-Trip issues should also be reported to the guide or the current emergency contact shown in your trip documents.
30.1 These Terms and the booking contract are governed by the laws of Nepal.
30.2 Before starting formal proceedings, both parties will try in good faith to resolve a dispute through the complaint process in Section 26. If unresolved, either party may request a meeting or mediation in Kathmandu, in person or remotely. Unless agreed otherwise, each party pays its own mediation costs and shares the mediator’s fee equally.
30.3 Subject to any mandatory consumer right to bring a claim elsewhere, the courts of Kathmandu, Nepal have exclusive jurisdiction.
31.1 Mandatory rights. If a law gives a Traveler a right or remedy that cannot be waived, that law prevails over any inconsistent part of these Terms.
31.2 Severability. If a provision is held invalid or unenforceable, it will be modified to the minimum extent necessary or removed, and the remaining provisions will continue in effect.
31.3 No waiver. A delay or failure to enforce a right is not a waiver of that right.
31.4 Assignment. You may not assign the booking except under Section 9. We may transfer the contract to a suitably qualified business that can perform it, provided your rights are not reduced, or as part of a lawful business reorganization.
31.5 Entire agreement. The documents listed in Section 2 contain the entire agreement about the booking and replace prior discussions or representations, except in cases of fraud.
31.6 Changes to these Terms. We may update these Terms for future bookings. The version in effect when your booking is confirmed applies to that booking unless a change is required by law or you agree to it in writing.
31.7 Language. These Terms are written in English. A translation may be provided for convenience, but the English version controls to the extent permitted by law and unless mandatory law requires otherwise.
31.8 Headings. Headings are for convenience and do not affect interpretation.
